Certificate of Appropriate Alternative Development (CAAD)

Where land subject to compulsory purchase is believed to have potential for a higher value alternative use, a claimant may apply for a Certificate of Appropriate Alternative Development (CAAD).

A CAAD application establishes whether an alternative form of development would have been granted planning permission in the “no-scheme world” — either at the date of valuation or at a future date. The outcome can materially affect the level of compensation payable under a Compulsory Purchase Order.

Securing a CAAD requires detailed planning analysis and a clear understanding of how development plan policy would have applied in the absence of the scheme.

Securing Alternative Development Value for Land Affected by a Road Scheme

Wreyland Rural Planning Consultants acted for a landowner whose property was affected by a road scheme in Gloucestershire, and the compulsory acquisition of a large part of his land. Although the land was in agricultural use, we advised on the potential for alternative development to ensure that compensation properly reflected its true value. As such applications are relatively uncommon and not always well understood by the planning authority, the submission was supported by a detailed planning report.

The report demonstrates how an equestrian enterprise would have complied with national and local planning policies, assisting the planning authority in reaching a favourable conclusion and strengthening the client’s position in relation to compensation.
